PRIVACY POLICY
This notice describes our Privacy Policy. Our privacy policy explains how DOLAN (Dolan Group, Inc.) collects, uses, and protects the personal information obtained through the use of our DOLAN website www.shopdolan.com (“Site”). By accessing or using the Site you are accepting the practices described in this Privacy Policy. Your use of our Site and any dispute over privacy, is subject to this Privacy Policy and our Terms of Service, including its applicable limitations on damages and the resolution of disputes. The Dolan Group, Inc. Terms of Service are incorporated by reference into this Privacy Policy.
We collect information about you directly from you and from third parties, as well as automatically through your use of our Site. You are not required to provide us with any personally identifiable information to access the Site. However, you are required if you will be making a purchase or would like to use certain features of the Site.
a) Information We Collect Directly From You. Certain areas and features of our Site, including to allow for streamlined checkout, require registration. To register you must provide at minimum your name, email address, physical address and any other information required in the Terms of Use. In addition, if you make a purchase, we also collect your payment information, such as your credit or debit card information, Paypal account information, any other payment method information and your billing address.
b) Information We Collect Automatically. We automatically collect information about your use of our Services through cookies, web beacons, and other technologies. We combine this information with other information we collect about you. Please see the section “Cookies and Other Tracking Mechanisms” below for more information.

(c) We do not collect any types of Sensitive Data from our users. Sensitive Data includes any PII pertaining to: race or ethnic origin, political opinions, religious or philosophical beliefs, trade union memberships, genetic or biometric data, health or mortality, and sex life or sexual orientation. Please immediately notify us if you have accidentally submitted any Sensitive Data and we shall promptly remove such information.
The information we collect is used for administering our business activities. No personally identifiable information is sold, gathered or used for any other purpose. We may additionally use the information to notify you about changes to our Site, new services, or special offers.
a) Communications. We may use your personal information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions in any mail we send (as further discussed in Section 11).
b) Reviews. Any user site or product reviews and/or photos submitted to www.shopdolan.com can be used for marketing purposes on DOLAN's website and third party platforms like social media and email channels. User's first name, last initial and job title/occupation may also be shared.
4. How We Share Your Information.
We may share your information, including personal information, as follows:
a) Business Transfers.If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the other company.
b) In Response to Legal Process.We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order or a subpoena.
c) To Protect Us and Others.We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Service or this Privacy Policy, or as evidence in litigation in which we are involved.
d) Aggregate and De-Identified Information.We may share aggregate or de-identified information about users with third parties for marketing, advertising, research or similar purposes.
We will not sell, trade, or rent your personally identifiable information to others. However, we do provide some of our services through contractual arrangements made with affiliates, service providers, partners and other third parties ("Service Partners"). Our Service Partners include Growave, ShipStation, Klarna, Report Pundit, Privy, ShopSync, Returnly, Mailchimp and Tax Receipts. Growave manages your rewards and referrals account information, including name, email address, preferences, order history, rewards points and earned rewards. ShipStation manages shipping logistics and triggers order shipping notifications.Klarna, when selected, manages split order payments. Report Pundit collects all sales and order analytic information, and does not collect any personal information. If you purchase any goods, Tax Receipts will provide your donation receipt. If you choose to return any items, Returnly will receive your name and address so they may properly facilitate the return or exchange in accordance with our Shipping and Return/Exchange Policies. We use Mailchimp to provide our email notifications and marketing. Your email is collected via Privy and provided to Mailchimp via ShopSync. We and our Service Partners may need to use some personal information in order to perform tasks between our respective sites, or to deliver services to you.
6. How We Protect Your Information.
To protect your personal identifiable information, we take reasonable precautions and follow industry standard SSL encryption of data to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your financial or any other personal information, the information is encrypted using industry standard protections in our database. No payment information is every stored in our database, as it is solely processed through third parties and is only temporarily stored during the processing of payment. All other information we collect may be stored in perpetuity through Shopify’s and Mailchimp’s databases or until our relationship ends with Shopify or Mailchimp. We cannot guarantee removal of your personal information from their databases.
Although we have implemented commercially reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction, please be aware that despite our best efforts, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

7. Payment.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction.After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. If you choose to make a purchase, payments are exclusively processed through Shopify Payments, Klarna and PayPal. Please refer to Shopify Payments, Klarna and PayPal privacy policies for information regarding their own security protections and use of your personal information. No payment information is stored on our Site after your order has been processed.
If you provide us with your financial or any other personal information, the information is encrypted using industry standard protections. Our payment processing is hosted via Shopify Pay, Klarna or PayPal. Please refer to Shopify Pay, Klarna and Paypal’s Privacy Policies (https://www.shopify.com/legal/privacy , https://www.klarna.com/us/privacy-policy/ and https://www.paypal.com/us/webapps/mpp/ua/privacy-full) for information regarding their own security protections and use of your personal information.
In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. Once you leave our Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Terms of Use.
8. Our Use of Cookies and other Tracking Mechanisms.
We use cookies and other tracking mechanisms to track information about your use of our Site. We may combine this information with other personal information we collect from you.
Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site, while others are used to enable a faster check out process or to allow us to track your activities at our Site. 9. Third Party Analytics.
We use Report Pundit, Crazy Egg and Google Analytics to evaluate usage and sales of our Site. We also may use other analytic means to evaluate our Site. We use these tools to help us improve our Site, performance and user experiences. These entities may use cookies and other tracking technologies to perform their services. We do not share your personal information with these third parties.
10. Third-Party Links.
When you click on links on our Site, they may direct you away from our Site. We are not responsible for the privacy practices of other websites and encourage you to read their individual privacy policies. If you visit a third-party website link from our Site, you do so at your own risk.
11. Opting Out of Emails.
We may send periodic promotional or informational emails to you through Mailchimp. You may opt-out of such communications by following the opt-out instructions contained in the email. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your any purchases or requests you have made or received from us.
12. Children.
The Site is not intended for use by children under the age of 13. DOLAN does not allow individuals under the age of 13 to sign up for the mailing list or make a purchase, nor do we knowingly collect or use any personal information from such children. If you are under the age of 13, do not submit any information to our Site. If we learn that we collected personal information from children under the age of 13, we will take steps to delete that information as soon as possible.
13. Changes to Privacy Policy.
If our Privacy Policy or procedures change, we will immediately post those changes on our Site. You can access our most recent Privacy Policy here: https://shopdolan.com/pages/privacy-policy. Any such changes will be effective immediately upon being posted, unless otherwise stated in the change.
14. California Residents Privacy Rights.
Pursuant to California Civil Code Section 1798.83, California residents who provide us with personal information in obtaining services for personal, family, or household use are entitled to request and obtain from us, one time per calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing uses. Alternatively, the law provides that a company may comply, as DOLAN does, by disclosing in its privacy policy that it provides consumers choice (opt-in or opt-out) regarding sharing personal information with third parties for those third parties’ direct marketing purposes, and information on how to exercise that choice. As stated above in this Privacy Policy, DOLAN provides you choice prior to sharing your personal information with third parties for their direct marketing purposes. If you do not opt-in or if you choose to opt-out at the time DOLAN offers that choice, DOLAN does not share your information with that identified third party for its direct marketing purposes.

The DOLAN mobile message service (the "Service") is operated by DOLAN (“DOLAN”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to DOLAN’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of DOLAN through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with DOLAN. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18559400242 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other DOLAN mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
We respect your right to privacy.
